The Legislature of the Commonwealth of Kentucky has delegated responsibility to local government units to adopt regulations designed to promote the public health, safety and general welfare. Flood damage prevention is among those responsibilities and each community in Kentucky must adopt an ordinance that meets or exceeds the minimum requirements of Federal Regulations in order to maintain good standing in the National Flood Insurance Program (NFIP). The NFIP is a program enabling property owners in participating communities to purchase insurance as a protection against flood losses in exchange for state and community floodplain management regulations that reduce future flood damages.

If a community adopts and enforces a floodplain management ordinance to reduce future flood risk to new construction in flood prone areas, the federal government will make flood insurance available within the community as financial protection against flood losses. The insurance is designed to provide an alternative to disaster assistance and to reduce the rising cost of repairing damage to buildings and their contents caused by floods.

If a community withdraws from the NFIP, federally backed flood insurance will no longer be available. No property owner or renter within the community will be able to purchase a new policy and existing flood insurance policies will not be renewed and lenders may call in mortgages. No Federal disaster assistance may be provided to repair insurable buildings located in a flood area. Federally insured or regulated lending institutions, such as banks and credit unions, must notify applicants seeking loans for insurable buildings that no loan that requires federally backed insurance is available and that the property would not be eligible for federal disaster relief.

Union County participates in the National Flood Insurance Program and is in good standing. Our community is at risk of flooding from the Ohio River and its tributaries. Homeowners insurance does not include flood coverage so a separate policy must be taken out to protect from flood damages. All development in a flood plain must have a permit to be in compliance.
