OPEN RECORDS POLICY

(KRS 61.870-KRS 61.884)

 

Submission of Open Records Request

All requests for copies or inspection of public records of Union County, Kentucky must be made in writing and submitted to the Records Custodian. A request may be sent electronically to kim.nance@unioncountyky.gov and should include a mailing address, phone number, and electronic signature. Requests may also be mailed to the Office of Union County Judge Executive or hand delivered (8:00 a.m. to 4:00 p.m., Monday through Friday, each week, except holidays) to:

The request must include the specific records the requester desires to have copied or to inspect, whether the records are requested for commercial or noncommercial use, and whether the requester is a resident of the Commonwealth of Kentucky.

Resident of the Commonwealth – defined as follows in KRS 61.870(10):

  1. An individual residing in Kentucky;
  2. A domestic business entity with a location in Kentucky;
  3. A foreign business entity registered with the Secretary of State;
  4. An individual that is employed and works at a location(s) within Kentucky;
  5. An individual or business entity that owns real property within Kentucky;
  6. An individual or business entity that has been authorized to act on behalf of an individual or business entity defined in paragraphs (a) to (e) of this subsection;
  7. A news-gathering organization as defined in KRS 189.635(8)(b)(1)(a)-(e).

Response to Open Records Request

The Records Custodian will respond within the number of business days required by law, including notification to the requesting party if additional time is needed under KRS Chapter 61.

If no such records are identified as requested, the request may be denied on those grounds.  If it is reasonably believed that another state agency is in possession of the records described in the request, the Records Custodian will provide the name and contact information of the appropriate records custodian to the requester.

If the requested records are not open for public disclosure, the Records Custodian will notify the requester with an explanation for withholding the responsive records and provide the specific statutory exemption as the basis for withholding.

 

Record Production

Noncommercial Purpose

Printing costs are $0.10 per page and additional fees shall be justified on any invoice.  When responsive records are requested to be in electronic format, the cost of the media and any mechanical processing may be charged.  Requester must also pay postage.  All fees, including postage, shall be paid before records are copied.

Commercial Purpose

If the request is for a commercial use, a certified statement stating the commercial purpose for which the records will be used must be included with the open records request.  The requester will be required to enter into a contract permitting the use of the public records for the stated commercial purpose for a specified fee.  All fees and postage shall be paid before records are copied.
